General Terms and Conditions of Sale
Effective as of 4 November 2026. This English version is provided for convenience; in case of discrepancy, the French version prevails.
Article 1 — Seller
moskiparis.com is operated by NEW TIME, SARL with a share capital of EUR 152,000, registered office 90 rue de la Haie Coq, 93300 Aubervilliers, France, Bobigny Trade and Companies Register 403 853 229, EU VAT number FR17 403853229, operating the MOSKI Paris brand ("MOSKI Paris"). Customer service: contact@moskiparis.com, [PHONE].
Article 2 — Scope
These Terms govern sales concluded on moskiparis.com between MOSKI Paris and any natural person acting for purposes outside their trade or profession (the "Customer"). Eyewear professionals are invited to order on pro.moskiparis.com, which is subject to separate terms. The Customer declares that they are of legal age and have legal capacity to contract. Confirming an order constitutes acceptance of the Terms in force on that date, which the Customer can save and print.
Article 3 — Products
The products offered (optical frames and sunglasses) are described with their essential characteristics on their product page: materials, dimensions (lens width, bridge, temples), colours and, for sunglasses, filter category under standard EN ISO 12312-1. Sunglasses bear the CE marking; category 4 lenses are not suitable for driving.
Optical frames. Optical frames are sold without prescription lenses. They are delivered with non-corrective demo lenses, which must not be worn as prescription lenses. To fit lenses suited to their eyesight, the Customer takes the frame to the optician of their choice. MOSKI Paris is not liable for lens fitting carried out by a third party or for damage caused to the frame on that occasion; the legal warranties remain applicable to defects of the frame itself.
Offers are valid while stocks last. If a product proves unavailable after an order, the Customer is informed and refunded without delay.
Article 4 — Prices
Prices are stated in euros including all taxes (VAT included), excluding delivery charges. Delivery charges are shown before the order is confirmed. For deliveries outside the European Union, customs duties and local taxes may apply and are payable by the Customer. The price invoiced is the price displayed when the order is confirmed.
Article 5 — Order and payment
The Customer selects products, checks the order summary and total price, corrects any errors, accepts the Terms and then confirms by clicking the order button with obligation to pay. The contract is formed upon this confirmation. A summary email is then sent to the Customer.
Payment is due when the order is placed. Depending on the options offered at checkout, the Customer may pay by bank card or PayPal (secured by Stripe and PrestaShop Checkout), by bank transfer, by cheque or in cash on delivery. MOSKI Paris never has access to bank card details. Orders paid by transfer or cheque are shipped once payment is received. MOSKI Paris may refuse an order in the event of a previous payment dispute or suspected fraud. The invoice is available in the customer account.
Article 6 — Delivery
The delivery methods offered are:
- Chronopost Chrono 18: home delivery within 24 working hours after shipment, before 6 pm;
- Click and collect: free collection at 90 rue de la Haie Coq, 93300 Aubervilliers, after receipt of the email stating that the order is ready.
Delivery areas and charges are shown at checkout. Unless another date is agreed, delivery takes place no later than 30 days after the order. Failing this, the Customer may, after formal notice that remains unanswered within a reasonable additional period, terminate the sale and be refunded within 14 days (Articles L216-1 to L216-7 of the French Consumer Code).
The risk of loss or damage passes to the Customer when they take physical possession of the products. The Customer should check the parcel on receipt and report any anomaly to the carrier and to MOSKI Paris as soon as possible.
Article 7 — Right of withdrawal
The Customer has 14 days from receipt of the product to withdraw, without giving any reason and without penalty (Articles L221-18 et seq. of the French Consumer Code). To do so, the Customer informs MOSKI Paris of their decision by an unequivocal statement, for example using the form below or by email to contact@moskiparis.com.
The Customer returns the products no later than 14 days after communicating their decision, to: NEW TIME – MOSKI Paris, 90 rue de la Haie Coq, 93300 Aubervilliers, France. Return costs are borne by the Customer.
MOSKI Paris refunds all sums paid, including initial delivery charges at the standard rate, within 14 days of receiving the withdrawal decision, using the same means of payment. The refund may be withheld until the products are received or proof of shipment is provided.
Products must be returned complete, in their original packaging. The Customer may be liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the products (normal trying on).
An optical frame must be returned with its demo lenses. A frame on which lenses have been fitted is no longer in its original condition: the resulting diminished value may be deducted from the refund (Article L221-23).
The right of withdrawal does not apply to products made to the Customer's specifications or clearly personalised (Article L221-28 3°).
Article 8 — Legal warranties
All products benefit from the legal guarantee of conformity (Articles L217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code).
Legal guarantee of conformity. The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish the existence of the lack of conformity, not when it appeared. The consumer is entitled to repair or replacement of the goods within 30 days of the request, free of charge and without major inconvenience. If repair or replacement is impossible, refused, not carried out within this period or the defect persists, the consumer may obtain a price reduction while keeping the goods, or terminate the contract and obtain a full refund upon returning the goods. A repair under the guarantee extends it by six months. A seller who obstructs the legal guarantee of conformity in bad faith is liable to a civil fine of up to EUR 300,000, which may be increased to 10% of average annual turnover (Article L241-5).
Guarantee against hidden defects. The consumer may act within two years of discovering the defect and may then choose between cancelling the sale and a price reduction (Article 1644 of the French Civil Code).
To make a warranty claim: contact@moskiparis.com, with the order number and a photo of the defect.
Article 9 — Liability
MOSKI Paris is not liable for non-performance of the contract attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to force majeure within the meaning of Article 1218 of the French Civil Code.
Article 10 — Intellectual property
The sale of products does not transfer any of NEW TIME's intellectual property rights in the MOSKI Paris trademark, its creations or its content.
Article 11 — Personal data
Data collected when an order is placed is necessary for processing, delivery and invoicing. It is processed in accordance with the GDPR; the Customer has the rights described in the Legal Notice, which may be exercised at contact@moskiparis.com.
Article 12 — Customer service and complaints
Any complaint should be sent to customer service: contact@moskiparis.com or NEW TIME – MOSKI Paris, 90 rue de la Haie Coq, 93300 Aubervilliers, France.
Article 13 — Archiving and evidence
Orders of EUR 120 or more are archived by MOSKI Paris for ten years; the Customer may access them on request (Article L213-1 of the French Consumer Code). MOSKI Paris's computerised records constitute evidence of communications and orders.
Article 14 — Consumer mediation
If a dispute is not resolved after a written complaint to customer service, the Customer may refer it free of charge to the consumer mediator to which MOSKI Paris belongs: [MEDIATOR NAME], [WEBSITE], [ADDRESS] (Articles L612-1 et seq. of the French Consumer Code). The mediator must be contacted within one year of the written complaint.
Article 15 — Governing law and jurisdiction
These Terms are governed by French law. Failing amicable settlement, disputes are brought before the competent court under ordinary rules; the consumer may choose the court of the place where they lived when the contract was concluded or when the harmful event occurred. A Customer residing in another EU Member State retains the protection of the mandatory provisions of their country of residence.
